Order, Judgment and Permanent Injunction with regard to defendants MSI Marketing, Inc., Professional Website Development, and Internet Business Services

The matter before the Court is plaintiff and defendants MSI Marketing, Inc., Professional Website Development, and Internet Business Services' Joint Motion for Entry of Permanent Injunction. The Court has reviewed the file and determined that there is no just reason for delay, and that judgment should be entered immediately in favor of plaintiff and against defendants MSI Marketing, Inc., Professional Website Development, and Internet Business Services. Accordingly, it is

ORDERED that the Joint Motion for Entry of Permanent Injunction is granted, and Judgment is entered pursuant to Fed.R.Civ.P. 54(b). It is

FURTHER ORDERED, ADJUDGED AND DECREED that defendants MSI Marketing, Inc., Professional Website Development, and Internet Business Services, any successor corporation, including Maximum Service Internet, Inc., and their officers, agents, servants, employees and representatives and all other persons, firms or corporations in active concert or participation with them, and all persons who receive actual notice of this Permanent Injunction, are hereby permanently enjoined from using plaintiff's Mark "Oppedahl & Larson" or the words "Oppedahl" or "Larson" in any "meta tags" appearing on or in Web pages owned and/or operated by them without authorization of plaintiff. It is

FURTHER ORDERED that since MSI Marketing, Inc., Professional Website Development, Internet Business Services, and Maximum Service Internet, Inc. represent that they offer leased services to web page owners and operators, including but not limited to domain name registration, and the leasing or other provision of space on their computer for web sites to reside, and that MSI Marketing, Inc., Professional Website Development, Internet Business Services, and Maximum Service Internet, Inc. do not control the content of such web sites or pages, the injunction described herein has no application to leased services. The injunction also does not apply to MSI Marketing, Inc., Professional Website Development, Internet Business Services, and Maximum Service Internet, Inc. insofar as the content of the web pages or sites reside on their computer as a result of the provision of leased services. It is

FURTHER ORDERED that MSI Marketing, Inc., Professional Website Development, Internet Business Services, and Maximum Service Internet, Inc. will provide to plaintiff, upon request, information they have regarding the persons who control the content of any web pages or sites which reside on their computer as a result of the provision of leased services should that become necessary due to inclusion in those pages or sites of "Oppedahl & Larson" or the words "Oppedahl" or "Larson".
