Order, Judgment and Permanent Injunction with regard to defendants Welch and Advanced Concepts

The matter before the Court is plaintiff and defendants Robert A. Welch and Advanced Concepts' Joint Motion for Entry of Final Judgment and Permanent Injunction. As defendants Welch and Advanced Concepts have consented to the jurisdiction of this Court, the Court need not consider their Motion for Dismissal. The Court has reviewed the file and determined that there is no just reason for delay, and that judgment should be entered immediately in favor of plaintiff and against defendants Welch and Advanced Concepts. Accordingly, it is

ORDERED that the Joint Motion for Entry of Final Judgment and Permanent Injunction is granted, and Judgment is entered pursuant to Fed.R.Civ.P. 54(b). It is

FURTHER ORDERED that pursuant to section 43(a) of the Lanham Act, 15 U.S.C. § 1125(a), and Colorado common law, defendant Welch, and any officers, agents, servants, employees and representatives and all other persons, firms or corporation in active concert or participation with Welch who receive actual notice of this Judgment and Permanent Injunction, are hereby permanently enjoined from using plaintiff's Mark "Oppedahl & Larson" or the words "Oppedahl" or "Larson" in Web pages without authorization of plaintiff. It is

FURTHER ORDERED that the Motion for Dismissal Of Robert A. Welch D/B/A Advanced Concepts is moot.
